Terms and conditions

This agreement takes effect when you create an account and start to use our services.

Subscription service

This Terms of Use Agreement, as modified from time to time in with the terms of this Agreement) is a legal agreement between You (‘Customer’, ‘You’, ‘Your’) and MightySighty (‘Company’, ‘Mighty’, ‘We’) and defines the terms and conditions under which you are allowed to use the services as defined below. This agreement takes effect when you create an account and start to use our services. MightySighty provides a monthly subscription DAM ‘data asset management’ service to enable clients to store, manage and share assets as they require.

Changes to these terms

We reserve the right to revise these terms from time to time. We will date and post the most current version of these terms o the website. Any changes will be effective upon posting the revised version of these terms of service o the website. Your continued access or use of any portion of the service constitutes your acceptance of these updates. If you don’t agree to any of the changes, we’re not obligate to keep providing the service, and you must cancel and stop using the service.

Service levels

Whilst our ambition is to always provide a perfect service from time to time unforeseen circumstances may result in our service being temporarily unavailable. When this happens we will work tirelessly to get Mighty back up and fully functioning as soon as possible. We will not be liable for any loss or damage arising from any unauthorised use of your accounts.

Updates

Mighty is a work in progress and our development team will continue to develop and improve the service we provide. We don’t imagine that this will ever change. If you would like to contribute to the review and development process please email support@mightysighty.com with your thoughts and we will review them with the existing UX process.

Taxes

Our services are subject to tax according to the location of the customer. These will be calculated at the time of purchase.

30 day free trial

You will need to provide payment details to qualify to use MightSighty on the 30 day free trial offer. If you are not completely happy or don’t wish to continue, you can cancel at any time. Please be aware if you do choose to cancel, any stored assets will be saved for 10 days and will then be removed. By agreeing to use our software to manage your data you are also agreeing to the terms of use of the company.

Payments

If any amount due is not received within the agreed payment terms then access and features of your account will not be made available until resolved. Customers are responsible for reviewing the pricing schedule, features and limits associated with its subscription plan. Renewals are charged automatically until such time that you terminate your agreement with us.

Subscription plan upgrade

If a user accesses, uses, or activates any features which are only included in a higher-priced subscription plan, Mighty may in its absolute discretion upgrade Customers account to the appropriate higher-priced subscription plan for the reminder of the order term and any renewals thereof. Customer agrees to pay fees associated with the upgraded Subscription Plan for the remainder of the order term and any renewals of the order term.

Cancellation

If you no longer require our service you can cancel your account at anytime. Please see refunds for more information.

Suspension and terms of services

We reserve the right, to temporarily suspend or terminate your access to the service at any time in our sole discretion, with or without cause and with or without notice. For example, we may suspend or terminate your access to or use of the Service for: (a) the actual or suspected violation of these Terms; (b) the use of the Services in a manner that may cause legal liability or disrupt others’ use of the Services; (c) the suspicion or detection of any malicious code, virus or other harmful code by you or in your account; (d) scheduled downtime and recurring downtime; (e) use of excessive storage capacity or bandwidth; or (f) unplanned technical problems and outages. If, in our determination, the suspension might be indefinite and/or we have elected to terminate your access to the Service, we will use commercially reasonable efforts to notify you through the service.

Refunds

Except otherwise provided in this agreement or required by law, we do not provide refunds or credits for partial or unused periods of service or mid-term downgrades.

Reactivation

MightySighty may charge a re-activation fee to re-activate a suspended account.

Disputes

Any dispute to a charge on a customer’s invoice must be made within 60 days of the date on the invoice that initially contained the disputed charge.

Data

Where data has been accidentally deleted by the end user. We may charge a data retrieval fee to recover that data. This service is only available for 60 days after the files have been deleted.
